Terms of Service
1. About these terms
These Terms of Service ("Terms") are a legal agreement between you and QalamClip ("QalamClip", "we", "us", "our"). They cover your use of qalamclip.com, the QalamClip web app and related services (the "Service").
By creating an account or using the Service, you agree to these Terms and confirm you have read our Privacy Policy. If you use the Service for an organisation, such as a masjid, institute, charity or business, you confirm you're authorised to accept these Terms for it, and "you" includes that organisation.
2. Eligibility and your account
- You must be at least 16 years old, and at least 18 to buy credits.
- Give us accurate information and keep it up to date. Don't impersonate anyone or create accounts by automated means.
- Keep your login details private. You're responsible for everything done through your account. Tell us straight away if you think someone else has accessed it.
- You may not sell, transfer or share your account. Team members should each use their own account (see section 3).
3. Workspaces and teams
Each account has a personal workspace. You can also create or join team workspaces.
- Team ownership: the owner of a team workspace controls it, including its members, roles, credits and content. Owners and admins are responsible for who they invite and for how members use the team.
- Shared content: projects, clips, collections and chats created in a team belong to that team and can be seen by its members. If you leave or are removed, that content stays with the team.
- Shared credits: credits belong to the workspace they were added to, and any member who can create projects there can use them.
- Deleting your account: if you're the only owner of a team, you'll need to hand over ownership before you can delete your account.
4. The Service
QalamClip takes a video you provide, by link or upload, and uses automated tools to transcribe it, find clip-worthy moments, reframe them for portrait formats, add subtitles and other features, and answer questions about it. We're always working on the Service, so features may change, be added or be removed.
Beta features. Features marked "beta", "preview" or "coming soon" are experimental. They may be incomplete, change without notice or be withdrawn, and are provided without any promises about how well they perform.
Limits. We may set reasonable limits on things like file size, video length, number of projects or request rates, to keep the Service fair and stable for everyone.
5. Your content
"Your Content" means everything you give the Service, including links, uploaded files, briefs, settings and chat messages, and everything the Service produces for you, including clips, transcripts, subtitles, titles, references and chat answers.
You keep ownership
As between you and us, you keep all rights in Your Content, and to the extent we have any rights in the output generated for you, we assign them to you. We don't claim ownership of any of it.
The permission you give us
You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transcribe, analyse, adapt, render and display Your Content. This is only to provide, secure and support the Service for you and your team, including through the service providers described in our Privacy Policy. The licence ends when Your Content is deleted from our systems, except for copies we must keep by law.
We don't use Your Content to train AI models. We won't use it publicly, for example in marketing or on our website, without your permission.
You need the rights
You confirm that you own Your Content, or have every right, licence and permission needed to submit it and to use and publish what you create from it. In particular:
- Other people's videos: if a lecture, khutbah or podcast belongs to someone else, such as a speaker, masjid, channel or publisher, get their permission before clipping and reposting it. A video being publicly available does not mean you're allowed to republish it.
- People who appear: make sure you're allowed to use the name, image and voice of anyone featured.
- Platform rules: you're responsible for following the terms of the platform the source video comes from and the platforms you post clips to.
We don't review Your Content before it's processed, and you're responsible for it and for how you use it.
6. AI output
- It may be wrong. Transcripts, subtitles, clip choices, titles, summaries and chat answers are generated automatically and may be inaccurate, incomplete or out of context. Review everything before you publish or rely on it.
- Scripture references are a research aid. Suggested Qur'an verses and hadith, including their wording, numbering, grading and relevance, may be wrong or mismatched. They are not a fatwa, religious ruling or scholarly verification. Check them against a trusted source or a qualified scholar before you publish.
- It may not be unique. Other users may get similar output from similar content.
- It isn't professional advice. Chat answers are not religious, legal, financial or medical advice.
7. Acceptable use
You agree not to use the Service to:
- infringe anyone's copyright, trademark, privacy, publicity or other rights;
- edit, cut or caption a speaker's words so they appear to say something they didn't, or falsely attribute statements, verses or hadith to anyone;
- create or spread content that is unlawful, hateful, harassing or defamatory, or that incites or glorifies violence or terrorism;
- create sexually explicit content or anything that exploits or endangers children;
- create deceptive synthetic media or deepfakes of real people;
- send spam, or manipulate views, likes or other engagement;
- get around DRM, paywalls or other access controls on source content;
- probe, attack, overload or disrupt the Service, or bypass its security, credit system or usage limits;
- scrape, copy or reverse-engineer the Service, or use its output to build a competing product;
- resell, sublicense or give others access to the Service without our written agreement;
- break any law, including sanctions and export-control laws.
We may investigate suspected breaches. We may also remove content, block processing, or suspend or close accounts that break these rules (see section 12).
8. Copyright complaints
We respect creators' rights, including those of the scholars and speakers whose work appears on QalamClip. If you believe content processed or stored on QalamClip infringes your copyright, email support@qalamclip.com with the subject "Copyright complaint" and include:
- your name and contact details, and your signature (a typed name is fine);
- the work you believe is being infringed;
- the infringing material and where it is, for example a clip or project link, with enough detail for us to find it;
- a statement that you believe in good faith that the use isn't authorised by the owner, their agent or the law;
- a statement that the information in your notice is accurate and that you are the owner, or authorised to act for them.
When we receive a valid complaint, we may remove or disable the material and let the user who submitted it know. If you think your content was removed by mistake, you can reply with a counter-notice explaining why. We close the accounts of repeat infringers where appropriate.
9. Credits and payment
How credits work
- Processing uses credits. Generating clips or chatting about a video costs about one credit per minute of source video. Some features, such as General Chat, cost a small fixed amount. Current costs are shown on our Pricing page and in the app.
- When a job starts, we reserve credits based on the video's estimated length. When it finishes, we charge for the actual length and return any difference.
- If a job fails and doesn't produce the result you asked for, its credits are returned to the workspace automatically.
- Credits have no cash value. They can't be sold, transferred between unrelated accounts or exchanged for money, and they are forfeited if the workspace they belong to is deleted.
Buying credits
- Credits are sold in bundles as one-time payments, processed by our payment provider, Stripe. There is no subscription and nothing renews automatically. The bundle, number of credits and price are shown before you pay.
- Purchased credits don't expire while the workspace they belong to exists.
- On a team workspace, only owners and admins can buy credits. Credits bought for a workspace belong to that workspace.
- Prices are shown before tax unless stated otherwise, and you're responsible for any applicable taxes.
- We may change bundle prices in the future. Changes won't affect a purchase you've already made.
- Custom arrangements, such as larger volumes or team workspaces billed separately, are confirmed to you in writing (your "Order"). An Order forms part of these Terms, and we may suspend processing on a workspace with overdue payments under an Order.
Refunds and cancellation
- Except as set out in these Terms or required by law, payments are non-refundable, and unused credits aren't refunded.
- Consumers in the UK and EU normally have a 14-day right to cancel a purchase. Because credits are digital content, we'll ask for your express consent to start supplying them straight away. When you give that consent, you acknowledge that you lose the right to cancel once credits are added to your account. If you cancel within 14 days and before any credits have been added or used, we'll give you a full refund.
- If something has gone wrong with a charge, contact us and we'll look into it.
10. Third-party platforms and services
The Service can work with content from, and produce content for, third-party platforms such as YouTube, Instagram and TikTok. We aren't affiliated with or endorsed by these platforms. Your use of them is governed by their own terms, and we aren't responsible for their availability, their content, or what they do with anything you post. We depend on outside infrastructure and providers, so some features may be affected by changes they make.
11. Our rights and your feedback
The Service, including its software, design, branding and our own content, belongs to us and our licensors. We give you a limited, non-exclusive, non-transferable, revocable right to use it in line with these Terms. You may not use the QalamClip name or logo without our permission.
If you send us suggestions or feedback, we may use them freely without paying you or owing you anything.
12. Suspension and termination
- You can stop using the Service and delete your account at any time in Settings.
- We may suspend or close your account, or remove content, if you seriously or repeatedly break these Terms, if the law requires it, or if it's needed to protect other users, third parties or the Service. Where it's reasonable, we'll tell you first and give you a chance to fix the problem.
- If we stop offering the Service altogether, we'll give you reasonable notice so you can download your clips, and we'll refund any prepaid credits you haven't used.
- When an account is closed, its content is deleted as described in our Privacy Policy, so download anything you want to keep first. Sections 5 (licence ends on deletion), 6, 9 (for amounts owed), 11 and 13 to 17 continue to apply after termination.
13. Disclaimers
We work hard to keep QalamClip reliable and useful, but the Service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, whether express or implied, including that the Service will be uninterrupted, error-free or secure, that output will be accurate or fit for a particular purpose, or that it won't infringe the rights of others. We aren't responsible for keeping backups of Your Content, so keep your own copies of anything important.
If you're a consumer, you have legal rights that these Terms don't affect, including the right to services performed with reasonable care and skill.
14. Limitation of liability
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited.
Otherwise, to the fullest extent permitted by law, we aren't liable for any indirect, incidental, special or consequential losses, or for loss of profits, revenue, audience, goodwill, data or business opportunity, arising from or related to the Service. This includes losses from content you publish, platform strikes or takedowns, and reliance on AI output.
Our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, and (b) 100 US dollars.
15. Indemnity
If you use the Service for business or organisational purposes, you agree to indemnify us against claims, losses and costs (including reasonable legal fees) brought by third parties that arise from Your Content, how you use or publish it, or your breach of these Terms, and to defend us against them. This includes copyright claims about videos you had no right to use. If you're a consumer, this applies only as far as the law allows.
16. Governing law and disputes
If you have a problem, please contact us first at support@qalamclip.com. Most issues can be resolved quickly that way.
These Terms are governed by the laws of the country where QalamClip is established, and its courts have exclusive jurisdiction. If you're a consumer, you still have the protection of the mandatory laws of the country you live in, and you can bring proceedings in your local courts.
17. General
- Changes to these Terms: we may update these Terms. For significant changes, we'll give you at least 14 days' notice by email or in the app. If you keep using the Service after the changes take effect, you accept them. If you don't agree, you can stop using the Service and delete your account.
- Entire agreement: these Terms, the Privacy Policy and any Order are the whole agreement between you and us about the Service.
- Assignment: you may not transfer your rights under these Terms without our consent. We may transfer ours as part of a merger, acquisition or sale of assets, and this won't reduce your rights.
- Severability: if any part of these Terms is found unenforceable, the rest still applies.
- No waiver: if we don't enforce a right immediately, we haven't given it up.
- Events beyond our control: we aren't responsible for delays or failures caused by events we can't reasonably control, including outages at our providers or third-party platforms.
- Notices: we'll send notices to your account email address. Please send yours to support@qalamclip.com.
